HNTR Terms and Conditions
These Terms and Conditions (the "Terms") are a binding legal agreement between you and HNTR ("HNTR", "we", "us" or "our"), meaning the operators of the hntr.art website and interface, which provides access to independent, public smart contracts. They govern your access to and use of the website at hntr.art and its subdomains, the HNTR smart contracts, HNTR Academy, and all related tools, content and community channels (together, the "Services").
PLEASE READ THESE TERMS CAREFULLY. They contain important disclosures about risk, a statement that HNTR is not an investment and gives no guarantee of profit, broad limitations of our liability, and (in Section 26) a dispute-resolution clause that requires you first to seek informal resolution and limits class or representative claims. By connecting a wallet, buying a membership, depositing into a Strategy Pool, claiming any amount, or otherwise using the Services, you confirm that you have read, understood and agree to these Terms. You re-confirm your agreement each time you use the Services. If you do not agree, do not use the Services.
1. Definitions
In these Terms:
- "Affiliate Program" means the HNTR referral and commission programme described in Section 12.
- "Commission" means any referral, level, rank or leadership amount payable under the Affiliate Program.

- "Membership" means a paid, Seat-Cap-limited licence to access the Services at a specific Tier, as described in Section 10.
- "NFT" means a non-fungible token recorded on a blockchain.
- "Pool Profit" means, for a Strategy Pool, the proceeds actually received by the Pool Contract from the sale of its NFT, less the purchase cost of that NFT and any costs or fees deducted by the contract logic.
- "Pool Contract" or "Vault" means the individual smart contract deployed for a specific Strategy Pool.
- "Seat Cap" means the Tier limit described in Section 10.4.
- "Smart Contracts" means all smart contracts deployed by or for HNTR, including the membership, commission and Pool Contracts.
- "Stablecoin" means USDT, USDC or any other stablecoin HNTR accepts from time to time.
- "Strategy Pool" means an automated, on-chain pool through which participating Members collectively acquire and resell an NFT, as described in Section 11.

- "Tier" means a Membership level (Bronze, Silver, Gold, Platinum or Diamond, or any other level HNTR introduces).
- "Wallet" means a self-custodial blockchain wallet controlled by you.
- "you" means the individual using the Services and, where applicable, any entity on whose behalf you act and any Wallet you use to access the Services.
2. What HNTR Is and Is Not
2.1 What HNTR is. HNTR is a technology and education service. It sells Memberships that grant access to software tools, Strategy Pools, HNTR Academy and a community. A Membership is a purchase of access to services. It is not an investment.
2.2 Not an investment, security, fund or financial product. HNTR is not an investment programme, investment scheme, collective investment scheme, fund, security, deposit, savings product, financial product or financial service. A Membership does not give you any equity, share, profit-participation right, debt claim, voting right or other ownership interest in HNTR. HNTR does not manage your assets on your behalf and does not act as your adviser, agent, trustee or fiduciary.
2.3 No advice. Nothing provided through the Services — including the website, HNTR Academy, social media posts, community chats, live sessions, or statements by HNTR staff, founders, moderators or affiliates — is investment, financial, trading, legal, tax or accounting advice, or a recommendation to buy, sell or hold any asset. You should obtain independent professional advice before making any financial decision.
2.4 Not an exchange, broker or marketplace. All trades happen on-chain. HNTR operates exclusively through the OpenSea marketplace using the Seaport protocol. HNTR is not an exchange, trading venue, broker, dealer, market maker, marketplace operator, payment institution, money transmitter or custodian. HNTR does not match, route, clear or settle orders; every purchase and sale is executed by smart contracts directly on the blockchain and the OpenSea/Seaport protocol.
2.5 No guarantees. HNTR does not guarantee any success, profit, income, return, yield or result of any kind. HNTR does not guarantee that any NFT will sell, at any price or within any time period.
3. Non-Custodial Service; Your Wallet
3.1 HNTR never holds your funds or keys. The Services are non-custodial. HNTR never holds, controls or has access to your Wallet, private keys, seed phrase or the assets in your Wallet. HNTR will never ask for your private key or seed phrase. Anyone who does so is not acting for HNTR.
3.2 Your responsibility. You are solely responsible for the security of your Wallet, devices, private keys, seed phrases, passwords and backup methods. HNTR is not responsible for any loss of, or loss caused by the loss, theft or compromise of, any Wallet, private key or seed phrase. HNTR cannot recover lost keys, restore access to a Wallet, or reverse or cancel any transaction.
3.3 Wallet is your identity. Your Wallet address functions as your identity on the Services. Any action taken from your Wallet, whether or not authorised by you, is treated as your action. If you believe your Wallet is compromised, stop using it with the Services immediately.
3.4 On-chain actions are yours. All deposits, payments and claims are made on-chain by you, from your own Wallet, by signing transactions yourself. HNTR does not deposit, pay or claim on your behalf, except where the Smart Contracts automatically perform an operation you have agreed to (for example, the automatic deposit described in Section 12.5).
3.5 Direct contract access. The Smart Contracts are public and can be used directly on the blockchain without the HNTR website. The website is a convenience interface only. If the website is unavailable, HNTR has no obligation to provide an alternative interface, but your on-chain rights under the contract code are not dependent on the website.
4. Eligibility and Age
4.1 Minimum age (self-declaration). You must be at least 18 years old, or the age of majority where you live if that is higher, and have full legal capacity to enter into binding contracts. By connecting a Wallet to the Services you confirm that you meet this requirement.
4.2 No verification. HNTR does not perform any identity or age verification. You are solely responsible for the accuracy of your self-declaration.
4.3 Acting for an entity. If you use the Services on behalf of a company or other entity, you confirm that you are authorised to bind that entity to these Terms and to sign blockchain transactions on its behalf, and "you" includes that entity.
5. Compliance with Laws and Sanctions
5.1 Your responsibility. You are solely responsible for knowing and complying with all laws and regulations that apply to you, including in relation to buying a Membership, depositing into Strategy Pools, participating in the Affiliate Program and paying taxes. HNTR makes no representation that the Services are appropriate or lawful for you.
5.2 Sanctioned persons. You must not use the Services if you are a person subject to sanctions (including persons on sanctions lists maintained by the United States (OFAC), the United Nations, the European Union or the United Kingdom), or if you are acting for or on behalf of such a person. By connecting a Wallet you represent that this does not apply to you. HNTR does not carry out sanctions checks and relies on your representation.
6. Your Representations
Each time you use the Services you represent and warrant that:
- you meet the age requirement in Section 4 and are not a sanctioned person or acting for one (Section 5);
- you are the lawful owner or authorised controller of the Wallet you use, and the assets you use are lawfully obtained and not derived from any unlawful activity;
- you understand how blockchains, Wallets, stablecoins, NFTs and smart contracts work, and you have read the Documentation and these Terms (including the risk disclosures in Section 8);
- you are buying a Membership to access services and education, and not as an investment or with an expectation of profit from the efforts of HNTR or others;
- you have made your own independent decision to use the Services and have not relied on any statement, promise, forecast or representation by HNTR, its staff, founders, affiliates or community members other than those expressly set out in these Terms;
- you can afford to lose the full amount of any Membership fee, deposit and Gas Fees; and
- you will comply with these Terms and all applicable laws, including tax, sanctions and anti-money-laundering laws.
7. The Smart Contracts
7.1 Code governs. The Services are executed by Smart Contracts deployed on the Ethereum blockchain. If there is any inconsistency between the deployed contract code and the Documentation or website, the deployed code controls as to what happens on-chain, followed by these Terms. Before signing any transaction, you are responsible for reviewing it in your Wallet.
7.2 Public and audited. The Smart Contracts are public and have been reviewed by an independent security auditor. An audit is not a guarantee: audits can miss bugs, and code may behave in unexpected ways. HNTR does not warrant that the Smart Contracts are free of errors, vulnerabilities or exploits.
7.3 Consent to automated operation. By interacting with the Smart Contracts you consent to their automated, programmatic operation, including payments, fee calculations, Commission distributions, automatic pool deposits, NFT purchases, listings, sales, transfers between Strategy Pools and settlement of claims, whether triggered by you, by HNTR, by a Keeper or by any other person permitted by the code. All on-chain transactions are final and irreversible.
7.4 Parameter updates and pausing. Certain parameters of the Smart Contracts (for example Membership Tier prices, Seat Caps, Affiliate percentages and the target sale premium of Strategy Pools) may be updated, and certain functions may be paused, by HNTR. HNTR intends that such changes apply going forward and will announce material changes on hntr.art, but the effect of any change is determined by the code. Find HNTR's official social channels on the homepage at HNTR.ART. Updating or pausing these parameters does not make HNTR a custodian or manager of your assets.
7.5 Forks and network changes. If a blockchain forks, upgrades or migrates, HNTR may decide in its sole discretion whether and how to support any resulting network or asset. HNTR is not responsible for any loss, duplication or incompatibility caused by such events.
8. Risk Disclosure
Using the Services involves significant risk. You could lose all of the money you spend or deposit. The risks include, without limitation:
8.1 Market volatility. The prices of crypto-assets and NFTs, including ETH and blue-chip NFT collections, are highly volatile and can fall sharply and quickly. Past performance of any collection or pool is not an indicator of future results.
8.2 Liquidity and indefinite holding. NFTs are illiquid. There may be no buyer at the target price or at any price. A Strategy Pool does not force a sale and has no deadline: once the NFT has been purchased, an unsold NFT can remain held by the Pool Contract indefinitely, and your committed deposit may remain locked and unrecoverable for an unknown period or forever. The floor price of a collection may fall below the price the pool paid.
8.3 Pool filling risk. A Strategy Pool may take a long time to fill, or may never fill, particularly if the cheapest listing price of the collection rises while the pool is filling, because the pool target rises with it (see Section 11.2). While a pool is filling you can withdraw your deposit (see Section 11.4), but you bear the Gas Fees and any change in the value of ETH in the meantime.
8.4 ETH and stablecoin risk. Deposits are made in ETH and Memberships are paid in Stablecoins. ETH can lose value. Stablecoins can lose their peg, be frozen or blacklisted by their issuer, or fail. Values shown in US dollars are approximations only.
8.5 Smart contract and technical risk. Smart contracts may contain bugs or vulnerabilities, may be exploited or hacked, and may fail to work as intended. Third-party contracts (including Seaport, OpenSea and NFT collection contracts) may change, fail or become incompatible.
8.6 Gas fees and network congestion. Every on-chain action requires Gas Fees, which are set by the network, are not refundable even if a transaction fails, and may be high during congestion. Transactions may be delayed, fail or get stuck.
8.7 Front-running and MEV. Public blockchain transactions can be observed before confirmation. Third parties may front-run, back-run, sandwich or otherwise exploit transactions (maximal extractable value, or "MEV"), which can change prices or outcomes for the pools or for you.
8.8 Oracle and Keeper risk. Some operations may depend on price data, oracles, indexers, RPC nodes or Keepers. These may be wrong, delayed, manipulated or unavailable, and Keepers are permissionless — anyone may trigger certain functions, or no one may.
8.9 Marketplace risk. Strategy Pools depend on OpenSea and the Seaport protocol. OpenSea may change its fees, policies or technology, delist a collection, block an address, or stop operating. The current 0% marketplace and creator fee for pools may change.
8.10 Regulatory risk. Laws and regulations on crypto-assets, NFTs, referral programmes and online services are developing and differ by country. New rules or enforcement action may restrict, change or end the Services, or make your participation unlawful under the laws that apply to you.
8.11 Tax risk. Buying, selling, depositing, claiming and receiving Commissions may have tax consequences, which may be complex and unfavourable.
8.12 Wallet and security risk. Phishing, malware, fake websites, impersonators and social-engineering attacks are common. Losing access to your Wallet means losing your assets permanently.
8.13 Business risk. HNTR is an early-stage, pre-launch project. HNTR may change, suspend or discontinue the Services, or fail as a business.
9. No Guarantees
9.1 HNTR makes no promise, guarantee or forecast of any success, profit, income, earnings, return or yield, whether from Strategy Pools, the Affiliate Program, HNTR Academy or anything else.
9.2 HNTR does not guarantee that any NFT purchased by a Strategy Pool will sell, at the target premium, at any price, or within any period of time.
9.3 Any examples, illustrations, calculators, historical figures, projected premiums (such as the current +10% target) or testimonials are for illustration only. They are not a promise or indication of what you will receive.
9.4 Prices, charts, analytics and other data displayed through the Services may be incomplete, delayed or inaccurate, and you should not rely on them for financial decisions.
10. Membership Terms
10.1 Tiers and prices. HNTR offers the following Tiers. Prices are in US dollars, payable in USDT or USDC on Ethereum through the membership Smart Contract:
Tier
Pre-launch price
Launch price
Seat Cap
Bronze
$50
$100
$400
Silver
$250
$500
$1,500
Gold
$750
$1,500
$5,000
Platinum
$1,500
$3,000
$8,000
Diamond
$2,500
$5,000
$20,000
Pre-launch prices are available for a limited period. HNTR may change prices, Tiers and Seat Caps at any time for future purchases (see Section 7.4). The price that applies is the one charged by the Smart Contract when your transaction is confirmed.
10.2 What a Membership gives you. A Membership gives you a limited, personal, revocable, non-transferable licence to access, according to your Tier: Strategy Pools, HNTR Academy, HNTR tools and the HNTR community, plus eligibility to participate in the Affiliate Program. A Membership does not give you any right to any NFT, any share of HNTR revenue (other than Commissions earned under Section 12), or any ownership interest in HNTR.
10.3 Non-refundable. Once a Membership payment is confirmed on-chain, it is final and non-refundable, except where a refund is required by mandatory law that cannot be excluded. Gas Fees are never refundable.
10.4 Seat Cap. Each Tier has a Seat Cap, which works in two ways:
- (a) Deposit limit: it is the maximum amount you may deposit into any single Strategy Pool, subject also to the pool's remaining capacity (see Section 11.3); and
- (b) Profit limit: it is the maximum Pool Profit you may receive before your Membership must be renewed or upgraded.
Only Pool Profit from NFT sales counts toward the Seat Cap profit limit. Commissions from the Affiliate Program do not count toward it.
10.5 Duration, renewal and upgrades. Your Membership stays active until your Pool Profit reaches your Seat Cap. You must then renew or upgrade your Membership to continue participating in Strategy Pools. Reaching the Seat Cap does not affect deposits and profits you have already earned, which remain claimable.
10.6 No transfer. Memberships are personal and tied to the purchasing Wallet. They may not be sold, transferred, assigned or shared, unless HNTR expressly states otherwise in writing or the Smart Contract expressly supports transfer.
11. Strategy Pool Rules
11.1 How a pool works. Each Strategy Pool has its own Pool Contract (Vault). In general: (a) while a pool is filling, Members deposit ETH from their own Wallets into the Pool Contract; (b) when total deposits reach the pool's current target (see Section 11.2), the contract buys the cheapest available listing of the eligible blue-chip NFT collection through Seaport on OpenSea; (c) the contract holds the NFT and lists it for sale at a target premium over the purchase price (currently +10%, which may change); and (d) when the NFT sells, participating Members may claim their deposit plus their pro-rata share of any Pool Profit from the Pool Contract.
11.2 Dynamic pool target. The pool's target tracks the cheapest listing price of the collection on OpenSea. If that price rises before the pool is filled, the target rises with it; if it falls, the target falls. The pool buys when total deposits reach the then-current cheapest listing price. By depositing, you accept that the target may change, up or down, while the pool is filling, and that the NFT may be bought at a price different from the one shown when you deposited.
11.3 Deposit limits. Each deposit is capped by the Smart Contract at the lesser of (a) your remaining Seat Cap and (b) the amount still needed to fill the pool.
11.4 Withdrawals while filling. You may withdraw your deposit, on-chain and at any time, while the pool is still filling (that is, before the contract has purchased the NFT). You pay the Gas Fees for the withdrawal.
11.5 Deposits committed after purchase. Once the contract has purchased the NFT, all deposits in that pool are committed and cannot be withdrawn. Your deposit and any pro-rata Pool Profit become claimable only when the NFT is sold.
11.6 Fully automated. Pool operations are executed by the code and may be triggered by a permissionless Keeper. HNTR does not choose individual trades outside the parameters set in the contracts and does not manage any pool on a discretionary basis.
11.7 Pro-rata shares. Your share of a pool's proceeds is proportional to your deposit relative to all deposits in that pool, as calculated by the contract. Rounding may apply.
11.8 Claims. You must claim your funds yourself, on-chain, from the Pool Contract by signing a transaction and paying Gas Fees. Proceeds are not automatically sent to your Wallet. Unclaimed funds remain in the Pool Contract and remain claimable by your Wallet.
11.9 No forced sale, no deadline. A Strategy Pool will not sell its NFT below the target listing price and has no deadline. If the NFT does not sell, it stays held by the Pool Contract indefinitely and your deposit remains locked. HNTR has no obligation to lower the price, sell the NFT, buy it, or return your deposit.
11.10 Sales between pools. A later Strategy Pool may buy an NFT owned by an earlier Strategy Pool at the then-applicable market or listing price, through OpenSea/Seaport. When this happens, the earlier pool's sale is completed and its Members may claim. You acknowledge that such transfers may occur, that the participants in the two pools may overlap, and that HNTR does not guarantee the price is the best available.
11.11 Fees. OpenSea marketplace fees and creator royalties are currently 0% for pool transactions; this is set by third parties and may change. You pay your own network Gas Fees for the transactions you sign.
11.12 No ownership of the NFT. The NFT is held by the Pool Contract. Depositing does not give you ownership of, or any right to receive, use or display, the NFT itself, or any intellectual-property rights in it.
12. Affiliate Program
12.1 Overview. Members may refer others to HNTR. When a referred person buys a Membership, Commissions are paid from that membership sale under the following structure, as set in the Smart Contracts:
- a 12-level unilevel structure totalling 65% of the membership sale price;
- a 5% rank bonus; and
- a 5% global leadership bonus.
The remaining 25% of membership revenue is retained by HNTR. HNTR intends to allocate half of its share (equal to 12.5% of membership sales) to buying NFTs for community Strategy Pools.
12.2 On-chain payment. All Commissions are paid on-chain, in USDT or USDC, by the Smart Contracts. HNTR does not pay Commissions in cash, by bank transfer or off-chain.
12.3 Commissions come only from real sales. Commissions are generated only from actual Membership purchases. No Commission is paid for recruitment alone, for signing people up without a Membership purchase, or for pool deposits or pool profits of others.
12.4 Withdrawable portion. 80% of each Commission is credited as withdrawable and may be withdrawn by you on-chain.
12.5 Automatic pool deposit. 20% of each Commission is automatically deposited by the Smart Contract into the active Strategy Pool on your behalf, and is subject to the pool rules in Section 11 and to all pool risks, including indefinite holding.
12.6 Earnings disclaimer. Participation in the Affiliate Program is optional and is not required to use the Services. Most participants in referral programmes earn little or nothing, and many earn less than they spend on their Membership and Gas Fees. Any earnings depend entirely on actual Membership purchases by real people and on your own effort, skill and circumstances. HNTR does not guarantee any level of income. Any income figures shared by HNTR or by other Members are not typical and are not a promise.
12.7 Not employment. Affiliates are independent. Nothing in these Terms creates an employment, agency, partnership, franchise or joint-venture relationship between you and HNTR. You may not bind HNTR or speak on its behalf.
12.8 Responsible promotion. When promoting HNTR you must:
- not make any income, earnings, profit or return claims, and not show screenshots of earnings as an inducement;
- not describe HNTR, a Membership or a Strategy Pool as an investment, security, passive income, guaranteed return or "risk-free";
- not promise or imply that any NFT will sell or that any pool will profit;
- not misrepresent the Services, the risks, your relationship with HNTR, or any affiliation with NFT collections or OpenSea;
- not send spam or unsolicited messages, and comply with all marketing, anti-spam and consumer-protection laws;
- not use HNTR trademarks in paid search, domains or account names without written permission;
- not target persons under the minimum age or sanctioned persons;
- not make cash-back or rebate offers, or pay others to join on your behalf.
12.9 Enforcement. If HNTR believes you have breached these rules or engaged in prohibited conduct, HNTR may, to the extent technically possible and lawful, suspend or terminate your Affiliate status, block your referral link through the interface, and/or update contract parameters so you do not receive future Commissions. HNTR may also report unlawful conduct to authorities.
12.10 Parameter changes. Level percentages, bonuses and the 80/20 split may be changed by the contract owner (see Section 7.4). Commissions already paid on-chain are not affected.
13. Fees, Gas and Taxes
13.1 You are responsible for all Gas Fees for transactions you sign. Gas Fees are paid to the network, not to HNTR, and are non-refundable.
13.2 All prices and fees are as charged by the Smart Contracts at the time of your transaction. HNTR does not control third-party fees (including OpenSea fees, creator royalties, stablecoin issuer fees or wallet fees).
13.3 Taxes are your responsibility. You are solely responsible for determining, reporting and paying any taxes (including income, capital gains, VAT/GST and sales taxes) arising from your Membership purchase, pool deposits, claims and Commissions. HNTR does not withhold or report taxes for you and does not provide tax advice, unless required by law.
14. HNTR Academy
HNTR Academy is provided for general educational and informational purposes only. It does not constitute financial, investment, trading, legal or tax advice, and it does not take into account your personal circumstances. Strategies or examples discussed in HNTR Academy may not be suitable for you and may result in losses. Academy content is licensed to you for personal, non-commercial use only and may not be copied, resold or redistributed.
15. NFT Collections, Trademarks and Third-Party Services
15.1 No affiliation with collections. Strategy Pools buy and sell NFTs from public collections, on-chain, through public marketplaces. HNTR has no partnership, affiliation, sponsorship or endorsement with any NFT collection or its creators, including Bored Ape Yacht Club (BAYC), Mutant Ape Yacht Club (MAYC), CryptoPunks, Pudgy Penguins, Azuki or any other collection, nor with their owners (such as Yuga Labs or others). All collection names, logos and trademarks belong to their respective owners and are referred to only to identify the collections (nominative use). HNTR makes no representation about any collection, its smart contracts, its creators or its future.
15.2 No affiliation with OpenSea. HNTR uses OpenSea and the Seaport protocol as a user of public infrastructure. HNTR is not affiliated with, endorsed by or a partner of OpenSea unless expressly stated.
15.3 Third-Party Services. Your use of Third-Party Services (including OpenSea, Seaport, wallet providers such as MetaMask, Etherscan, RPC providers, oracles and Keepers not operated by HNTR) is governed by their own terms and privacy policies. HNTR does not control and is not responsible for Third-Party Services, their availability, security, fees or conduct.
16. Intellectual Property
16.1 HNTR and its licensors own all rights in the Services, including the HNTR name and logo, website, software, user interface, HNTR Academy content, text, graphics and designs, except third-party materials and any components released under an open-source licence (which are governed by that licence).
16.2 HNTR grants you a limited, revocable, non-exclusive, non-transferable licence to use the Services for your personal use in accordance with these Terms. You may not copy, modify, distribute, sell, reverse-engineer (except as permitted by law or an open-source licence) or create derivative works from the Services, or use HNTR's trademarks without written permission.
16.3 Feedback. If you provide suggestions, ideas or bug reports, you grant HNTR a perpetual, irrevocable, worldwide, royalty-free licence to use them without compensation to you.
16.4 Security reports. Please report suspected vulnerabilities responsibly by contacting support on site (Support section at hntr.art) and do not exploit or publicise them before HNTR has had a reasonable opportunity to address them. Unless HNTR publishes a bug-bounty programme, no reward is promised.
17. Prohibited Conduct
You must not, and must not attempt to:
- exploit, attack or abuse any bug, vulnerability or unintended behaviour of the Smart Contracts or website, or extract value in a way not intended by HNTR;
- use bots, scripts or automated tools to abuse the Smart Contracts, manipulate pool timing or purchases, or gain an unfair advantage (operating a Keeper strictly within its intended public functions is permitted);
- front-run, sandwich or otherwise manipulate transactions of the pools or other Members, or engage in wash trading, spoofing, or market manipulation of any NFT collection;
- create or control multiple Wallets or accounts to self-refer, generate Commissions on your own purchases, bypass Seat Caps, or manipulate rank or leadership qualifications ("multi-accounting");
- use the Services for money laundering, terrorist financing, fraud, sanctions evasion or any other unlawful purpose, or use assets derived from crime;
- phish for, or attempt to obtain, other users' keys, seed phrases or credentials, or impersonate HNTR or its staff;
- interfere with, overload or disrupt the Services or networks (including denial-of-service attacks), or introduce malware;
- use non-public information about pool timing or parameters to trade ahead of the pools;
- misrepresent your age or sanctions status; or
- breach any applicable law or these Terms.
18. Wallet-Based Access; No KYC
HNTR is a Web3, wallet-based, on-chain service. There is no account registration and no identity verification ("KYC"), and HNTR does not collect personal data to provide the Services. Connecting your Wallet is the only means of access. You remain solely responsible for ensuring that the funds you use are lawfully obtained and that your use of the Services complies with the laws that apply to you, including anti-money-laundering laws.
19. Suspension and Termination
19.1 HNTR may, at any time and without liability, suspend, restrict or terminate your access to the website, interface, HNTR Academy, community channels or Affiliate Program, or block your Wallet through the interface, if HNTR reasonably believes you have breached these Terms or applicable law, pose a security or legal risk, or if required by law or a competent authority.
19.2 HNTR may modify, suspend or discontinue all or part of the Services at any time. Where reasonably possible, HNTR will give notice on hntr.art. Find HNTR's official social channels on the homepage at HNTR.ART.
19.3 Termination of your access to the interface does not by itself remove funds you are entitled to under the Smart Contract code, which you may continue to claim directly on-chain where the code permits. Membership fees are not refunded on termination, except where required by mandatory law.
19.4 You may stop using the Services at any time.
20. Disclaimer of Warranties
THE SERVICES, SMART CONTRACTS, HNTR ACADEMY AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HNTR DISCLAIMS ALL WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR FREE FROM BUGS, VIRUSES OR EXPLOITS. NO ADVICE OR INFORMATION FROM HNTR CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
21. Exclusion and Limitation of Liability
21.1 No responsibility for losses. To the maximum extent permitted by applicable law, HNTR is not responsible or liable for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential, exemplary or punitive, including loss of funds, crypto-assets, NFTs, profits, revenue, income, Commissions, opportunity, data or goodwill, arising out of or in connection with the Services, the Smart Contracts or these Terms, however caused and on any theory of liability (contract, tort including negligence, statute or otherwise), even if HNTR was advised of the possibility of such loss.
21.2 Hacks, exploits and third-party failures. Without limiting Section 21.1, HNTR is not responsible for any loss resulting from: hacks, exploits or attacks; smart contract bugs, errors or vulnerabilities (in HNTR's or third parties' contracts); security breaches or failures of Wallets, wallet providers, OpenSea, Seaport, NFT collection contracts, blockchains, validators, RPC providers, oracles, Keepers, stablecoin issuers or any other third party; phishing or impersonation; network congestion, forks or outages; MEV or front-running; NFTs not selling or falling in value; changes in law; or your own mistakes (including sending to a wrong address or signing a malicious transaction).
21.3 Mandatory law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for fraud, or, under some laws, for death or personal injury caused by negligence, or for gross negligence or wilful misconduct). If you are a consumer, you may have statutory rights that these Terms cannot override.
22. Indemnification
You agree to defend, indemnify and hold harmless HNTR and its operators, contributors, contractors and agents from and against any claims, losses, liabilities, damages, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your breach of these Terms or of any law; (c) your violation of any third-party right; (d) any promotional statements or conduct by you as an affiliate; and (e) any taxes owed by you. HNTR may assume control of the defence of any matter, and you will cooperate with HNTR.
23. Force Majeure
HNTR is not liable for any delay or failure to perform caused by events beyond its reasonable control, including blockchain or network failures, forks, congestion, attacks, failures of Third-Party Services, stablecoin de-pegging or freezing, power or internet outages, natural disasters, pandemics, war, terrorism, civil unrest, strikes, government action, sanctions or changes in law.
24. Privacy
24.1 No personal data required. HNTR does not require account registration and does not collect personal data such as your name, address, identity documents or date of birth to provide the Services. Connecting your Wallet is the only means of access.
24.2 Support requests. If you contact support on site (Support section at hntr.art), HNTR will use the information you choose to send only to respond to your request and will not sell it or use it for marketing.
24.3 Technical data. The website and its hosting, security and wallet-connection providers may process limited technical data (such as browser type or connection data) as needed to deliver and protect the website. HNTR does not use this data to identify you.
24.4 Public blockchain data. Blockchain transactions are public and permanent. Your Wallet address, transactions, deposits, claims and Commissions are visible to anyone, and HNTR cannot delete, change or hide them.
25. Changes to These Terms
HNTR may update these Terms from time to time. Changes take effect when the updated version is posted on hntr.art with a new "Last updated" date. Find HNTR's official social channels on the homepage at HNTR.ART. Your continued use of the Services after changes are posted means you accept them. If you do not agree, stop using the Services. Changes do not apply retroactively to disputes that arose before the change.
26. Disputes
If you have a dispute or complaint about the Services or these Terms, you agree first to contact support on site (Support section at hntr.art) with a description of the issue and to try in good faith to resolve it informally for at least thirty (30) days. If it cannot be resolved informally, it will be resolved in accordance with applicable law. To the extent permitted by applicable law, claims may be brought only on an individual basis and not as part of any class or representative proceeding.
27. General
27.1 Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent possible and the remaining provisions will continue in full force.
27.2 Entire agreement. These Terms, together with the Documentation, are the entire agreement between you and HNTR about the Services and replace any prior understanding.
27.3 No waiver. HNTR's failure to enforce any right is not a waiver of that right.
27.4 Assignment. You may not assign or transfer these Terms without HNTR's written consent. HNTR may assign or transfer these Terms, for example to a successor operator of the Services.
27.5 No third-party rights. Except for the indemnified persons in Section 22, no third party has any right to enforce these Terms.
27.6 Survival. Sections that by their nature should survive termination — including Sections 2, 3, 8, 9, 13, 15, 16, 20, 21, 22, 26 and 27 — survive.
27.7 Language. These Terms are written in English. Any translation is for convenience only; if there is a conflict, the English version prevails.
27.8 Notices. HNTR may give you notice through the website or the interface at hntr.art. You must send legal notices to HNTR by contacting support on site (Support section at hntr.art). Find HNTR's official social channels on the homepage at HNTR.ART.
